Terms of Service

1. Who we are

Sourced AI Inc. ("Sourced", "we") operates a self-service hiring platform at sourced.la that connects US-based companies with pre-vetted remote professionals in Latin America. These Terms apply to two kinds of users: (a) Hiring Companies — businesses that search, unlock, and contact candidates; and (b) Candidates — individuals who submit a profile to be discoverable. Some sections apply only to one of them; we call that out where it matters.

2. Accounts

You must be at least 18 and able to enter into a binding contract. You are responsible for activity under your account and for keeping your credentials secure. Notify us at legal@sourced.la if you suspect unauthorized access.

3. What the Service does

We use AI to help match Candidates and Hiring Companies — including parsing CVs, generating English summaries, classifying skills, translating company context, and interpreting natural-language searches. AI assists; humans make hiring decisions. Sourced does not screen Candidates in or out of consideration on the basis of any protected characteristic and does not score Candidates with an automated employment decision tool. Final hiring decisions, outreach, interviews, offers, and employment relationships are between Hiring Companies and Candidates.

4. Hiring Company terms

4.1 Acceptable use. You will use unlocked Candidate data only to evaluate and contact Candidates for roles at your own company. You will not (a) resell, redistribute, or publish Candidate data; (b) use Candidate data to train machine-learning models; (c) include Candidate data in prompts to third-party AI services other than those you have separately contracted; (d) send mass unsolicited outreach unrelated to a specific role.

4.2 Equal employment. You are solely responsible for compliance with US federal, state, and local employment laws — including Title VII, the ADA, the ADEA, and any AI-in-hiring statutes that apply to your jurisdiction (e.g., NYC Local Law 144, the Illinois AI Video Interview Act, the Colorado AI Act). You will not request that Candidates be filtered by race, religion, national origin, age, gender, disability, or other protected categories.

4.3 Per-role pricing. The per-role fee covers Sourced's services to source and present Candidates. It is not a placement fee, finder's fee, or commission tied to hiring outcome. Refund policy: full refund within 7 days if no Candidates were unlocked; otherwise non-refundable.

4.4 Plans. Subscription plans renew until cancelled. Cancellations take effect at the end of the current billing period. Fees are billed in USD via Stripe.

5. Candidate terms

5.1 Your profile. The information you submit (CV, work history, education, English level, salary expectation, country, photo, contact details) is yours. You grant Sourced a non-exclusive, worldwide, royalty-free license to host the profile, generate AI-derived summaries from it, and display it to Hiring Companies through the Service.

5.2 Visibility. Until a Hiring Company unlocks your profile, only non-identifying fields are publicly visible (first name, last initial, country, skills, experience summary). Contact details (email, phone, LinkedIn) are revealed to a Hiring Company only after they unlock your profile.

5.3 Removal. You can request profile removal at any time at legal@sourced.la or from your account settings. We remove the profile from search within 7 days and from backups within 90 days. Unlocks that already happened cannot be un-revealed — that data is with the Hiring Company and governed by their own retention policy.

5.4 Honesty. You confirm the information you submit is true and yours. Submitting someone else's CV or fake credentials terminates your account.

6. AI processing

We process Candidate profiles, CVs, and Hiring Company queries with AI services from OpenAI, Anthropic, Google (Gemini), and AssemblyAI. We use enterprise/API tiers where the provider contractually does not train on our data. We do not sell personal data to AI providers. Outputs of AI (summaries, search interpretations, match scores) are assistive and may be incorrect — humans should verify before acting.

7. Acceptable use (all users)

Do not scrape the platform, reverse-engineer it, abuse the API, send spam, attempt to bypass unlocks, or use the Service to violate any law. We may suspend accounts that breach these Terms.

8. Service availability

We work to keep the Service available but do not guarantee uninterrupted access. We may modify or sunset features with reasonable notice.

9. Disclaimer

The Service is provided "as is". We do not guarantee that any Candidate is hired, that any hire is a fit, or that any AI-generated output is accurate.

10. Limitation of liability

To the maximum extent permitted by law, Sourced's total liability for any claim arising out of or related to the Service will not exceed the greater of (a) USD 100 or (b) the fees you paid Sourced in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Indemnity (Hiring Companies)

You will defend and indemnify Sourced from third-party claims arising out of your use of Candidate data, your hiring decisions, your outreach, or your breach of Section 4.

12. Termination

You can stop using the Service at any time. We may suspend or terminate accounts that violate these Terms with notice when feasible.

13. Governing law and disputes

These Terms are governed by Delaware law without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts of Delaware. Both parties waive jury trial and class-action rights to the extent permitted by law.

14. Changes

We may update these Terms. Material changes will be announced by email or in-product notice at least 14 days before they take effect.
